1. Definitions
- "Estavia", "we", "us", "our" — the educational organisation operating at 94 Chang Khlan Road, Chang Khlan, Chiang Mai 50100, Thailand.
- "Programmes" — the educational sessions offered by Estavia, including the Estate-Organisation Orientation, the Records & Document Cataloguing Workshop, and the Family-Business Continuity Information Programme.
- "Participant", "you", "your" — any individual or organisation that accesses this website or books a programme.
- "Content" — all written materials, templates, checklists, and facilitation guides provided by Estavia in connection with its programmes.
- "Agreement" — these Terms & Conditions in full.
2. Acceptance of Terms
By accessing this website or enrolling in any Estavia programme, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, please do not use the website or attend any programme.
Participants must be at least 18 years of age. By booking a place, you confirm that you meet this requirement and have the legal capacity to enter into an agreement.
3. Description of Programmes
Estavia provides educational programmes on estate organisation, record management, and family-business continuity. All programmes are informational and educational in nature. Estavia does not provide legal, financial, tax, investment, or professional advice of any kind.
Programmes are delivered in person in Chiang Mai, Thailand. Availability depends on scheduled session dates. Estavia reserves the right to reschedule or cancel sessions due to insufficient enrolment or other operational reasons, with advance notice to affected participants.
4. Participant Responsibilities
- Provide accurate information when making an enquiry or booking
- Attend sessions with a willingness to engage respectfully with facilitators and other participants
- Use programme materials solely for personal, family, or internal organisational purposes
- Not reproduce, redistribute, or resell Estavia content without written permission
- Refrain from disruptive conduct during sessions
5. Intellectual Property
All programme materials, templates, checklists, and facilitation guides produced by Estavia are the intellectual property of Estavia. Participants are granted a limited, non-exclusive, non-transferable licence to use materials for personal or internal organisational purposes only.
No materials may be reproduced for commercial purposes, shared publicly, or used to develop competing educational products without prior written consent from Estavia.
6. Payment Terms
Programme fees are stated in Thai Baht (฿) and are payable prior to attendance. Accepted payment methods will be confirmed at the time of booking.
Cancellation and refunds: Cancellations made more than 7 days before a session date will receive a full refund. Cancellations within 7 days of the session will receive a 50% refund. Cancellations on the day of the session are non-refundable. Estavia may, at its discretion, offer a transfer to an alternative session date in lieu of a refund.
7. Disclaimers
Estavia's programmes are provided for educational and informational purposes only. Nothing in any session, material, template, checklist, or communication from Estavia constitutes professional advice of any kind — including financial, legal, tax, accounting, investment, or estate planning advice.
Participants are encouraged to consult qualified professionals for advice specific to their personal circumstances. Estavia makes no representations about the suitability of its educational content to any particular situation.
8. Limitation of Liability
To the fullest extent permitted by applicable Thai law, Estavia shall not be liable for any direct, indirect, incidental, or consequential loss or damage arising from participation in its programmes or reliance on its educational content.
Estavia's total liability, if any, shall not exceed the programme fee paid by the participant for the specific session in question.
9. Indemnification
You agree to indemnify and hold Estavia, its staff, and its facilitators harmless from any claims, losses, or damages (including reasonable legal costs) arising from your breach of this Agreement or your use of programme content in an unauthorised manner.
10. Termination
Estavia reserves the right to remove any participant from a session or decline future bookings from an individual or organisation if their conduct is disruptive, harmful, or in breach of this Agreement. In such cases, a partial or full refund may be offered at Estavia's discretion.
11. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the Kingdom of Thailand. Any dispute arising from or relating to this Agreement shall first be addressed through good-faith negotiation between the parties.
If resolution cannot be reached informally, disputes shall be submitted to the competent courts of Chiang Mai Province, Thailand.
12. General Provisions
- Entire agreement: These Terms constitute the entire agreement between you and Estavia regarding programme participation.
- Severability: If any provision is found unenforceable, the remainder of the Agreement continues in full effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of future enforcement rights.
- Assignment: You may not assign your rights or obligations under this Agreement without Estavia's prior written consent.
13. Changes to These Terms
We may revise these Terms from time to time. Updated Terms will be posted on this page with a new effective date. Continued use of the website or participation in programmes after an update indicates your acceptance of the revised Terms.
